The DFP and the Future of Off-Leash
in Santa Barbara

Part I: Fast Moves

The City of Santa Barbara seems to be having as much trouble with the phrase "as-is" as Bill Clinton had defining the words "is" and "sex." How else to explain its insistence on revisiting the issue of what to do with the Wilcox/DFP?

Despite overwhelming public opinion and consultants' advice that the Preserve's use remain "as-is," City Council voted in September of 1999 to authorize an Environmental Impact Review (EIR), with emphasis on dog use of the property. That should have been that, right?

R-I-I-I-g-h-tÖ.

Last week, in a surprise attempt to bypass both the DFP Advisory Committee (DAC) and the public comment process, Parks & Recreation asked to postpone the EIRs of both the DFP and two other proposed off-leash sites (see page 2). Instead, they propose a series of "technical studies" focusing primarily on dogs' impact on the property, and suggest immediate measures, including seeking approval for the design of a fenced dog "run"-even though City Council has clearly indicated lack of support for a dog enclosure.

In response to strongly-voiced objections by both Dog PAC and members of the DAC, City Council has sent the proposal back to the DAC for consideration. The question they must consider: can these shortcuts save time and money and still do justice to the issues involved in managing the Preserve?

ACTION ALERT! The DAC will meet soon. We need to remind them where we stand on the presence of dogs at the DFP!

Let the Committee know:
• You walk your dog off leash
• You oppose a fenced enclosure at the DFP
• You want to see the Preserve's use remain as-is

Part II: One is Not Enough

The issue of off-leash use at the DFP comes with its own neat irony, of course.

The Planning Commission has proposed EIRs for two additional off-leash areas: part or all of the beach stretching from Shoreline Park to Arroyo Burro (and possibly west to the city limits); and Hale Park, in Montecito. The thinking: we need more than one off-leash area, and one type of terrain, in order to meet demand and minimize the impact on any one off-leash area.

Now, Parks & Rec. is asking to postpone the other two EIRs as well as the EIR of the DFP, due to the cost involved (somewhere on the order of $200,000).

The irony, of course, is that this approach overlooks the big picture of off-leash need and demand, instead keeping the entire burden of use on the DFP. As a result, Parks & Rec. seeks to perform "technical studies" of dog use at the DFP at a time when that use is growing because of a lack of alternatives. Its proposals to mitigate impact will reflect this increase without providing for alternatives that would themselves ease the burden on the Preserve by spreading use out over multiple locations.

ACTION ALERT!: Letters in support of off-leash recreation make a difference!

The Mayor and City Council need to know:
• We are committed to keeping the DFP as is!
• Our tax dollars entitle us to off-leash recreational areas!
• Multiple off-leash areas are a way to mitigate environmental impact!

County Crackdown on Dogs in Dining Patios

The days of dining al fresco with your best friend appear to be history in Santa Barbara.

The County has informed local restaurant owners that the prohibition against having dogs in restaurants applies equally to outdoor dining areas.

The Environmental Health Services Department cites section 114045 of the California Health & Safety Code, in which dogs (other than seeing eye, guide, and service animals) are prohibited from being in any food facility. When one local eatery insisted that the Code did not apply to outdoor dining areas, the County countered with additional sections of the Code, in which outdoor areas are construed to be part of a food facility.

However, there is a logical inconsistency in the Code. Section 114030 requires that "[a] food facility shall at all times be so constructed . . .as to prevent the entrance and harborage of animals, birds, and vermin, including, but not limited to, rodents and insects." How can patio areas be considered part of a food facility, when they so clearly cannot comply with this requirement? And what is the status of dogs immediately adjacent to patio areas?

The Big Dog Parade

Everybody loves a parade—especially one dedicated to dogs!

That's why the Big Dog Parade, Santa Barbara's annual tribute to canines of all sizes, is growing with each passing year.

This year's event will be held on Saturday, June 2
Line-Up at De La Guerra Plaza. Registration Time: 8:30 a.m.
Parade Start Time: 9:30 a.m.
Canine Festival at Old Chase Palm Park immediately following parade.

The parade lets your dog strut his stuff, while you can enjoy contests and raffle prizes, live music and vendors-and all mere feet from the beach.

A Chance at Adventure—Off-Leash Recreation in State Parks

Consider it a way to turn lemons into lemonade.

Recent conflicts between Bay Area dog walkers and the National Parks system have re-energized the debate over the right to off-leash recreation in public spaces. State Senator Jackie Speier (42nd district) has responded by initiating the legislative process to establish off-leash areas in California's state parks.

SB 712 would require the State Department of Parks & Recreation to conduct a feasibility study regarding state park locations and conditions that would support off-leash recreation. At a minimum, the study would include:

• Public hearings throughout the state, and a comment area on the department's web site, to gather public comment on the issue;
• Consideration given to sections and times set aside for off-leash activity;
• Recommendations for rules for off-leash conduct necessary to protect the safety and enjoyment of park users and the integrity of the park land.
• Identifying specific park areas and parks that are suitable for off-leash use that would have the highest usage for the purpose due to proximity to urban areas
• Identifying specific reasons why off-leash activity should not be allowed at a given location

The Inside Scoop— Elings Park

In response to user demand, Elings Park has established a pilot dog walking program.

Created by the Elings Park Dog Owners Group (EPDOG), Dog PAC, and Elings staff, the program has enrolled over 350 dogs to date and has raised over $19,000 for the Park.

Critics complain about the $52 annual per dog fee. But dog play damages the grounds, which must be maintained for a variety of recreational uses. And since Elings Park is supported entirely by private donations, it cannot look to public funds to cover such costs.

Dog PAC supports the Park's right, as a private foundation, to charge user fees. However—WE DO NOT CONSIDER ELINGS PARK A MODEL FOR OFF-LEASH RECREATION AT PUBLIC PARKS. We continue to advocate for off-leash access for all responsible dog owners at designated public parks.
